WHAT IS COMMUNITY PROPERTY DIVISION?

Louisiana community property law can be complicated, but the basic concept is straightforward. In most cases, each spouse is entitled to one-half of the community property—meaning the assets and debts acquired during the marriage. To determine what each spouse is owed, the community is generally valued by identifying the assets, identifying the debts, and calculating the net value.

In addition, the law may allow reimbursements or credits in certain situations. For example, after a divorce is filed, a spouse who pays community debts using separate income may be entitled to reimbursement. These issues are highly fact-specific and often make a significant difference in the final division.
