A child custody case involves a court order that determines (1) who makes major decisions for a child and (2) the schedule of time each parent has with the child. In Louisiana, joint custody is often favored, but joint custody does not mean an equal 50/50 schedule.
When parents share joint custody, courts may designate one parent as the domiciliary parent, meaning that parent has final decision-making authority when the parents cannot agree. Custody decisions are based on the child’s best interest, and courts consider many factors—courts often place significant weight on a parent’s willingness and ability to encourage a healthy relationship between the child and the other parent—unless safety concerns make that inappropriate.
